By using the Site or purchasing a product, you ("the Customer") agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Site or purchase any product.

What We Sell

The Site sells digital products, including but not limited to sound design presets, themes and skins for music production software (e.g. Ableton Live, MiniMeters, Serum 2), sample packs, and other digital creative assets ("Products"). All Products are delivered electronically; no physical goods are shipped.

We may add new Products to the Site from time to time. These Terms apply to all Products sold via the Site unless a specific Product page states otherwise.

Purchases and Payments

All purchases are one-time payments. We do not currently offer subscriptions.

Payments are processed by Stripe. We do not store your payment card details ourselves — this is handled entirely by Stripe in accordance with their own terms and security standards.
Prices are displayed at checkout and are inclusive of any VAT/taxes as required by applicable law, unless stated otherwise.
You are responsible for providing accurate billing information.

Delivery

Upon successful payment, you will receive:

An instant download link on the confirmation page, and
A copy of the download link via email to the address provided at checkout.

It is your responsibility to provide a correct and active email address at checkout. We are not responsible for non-delivery caused by an incorrect email address, spam filtering, or similar issues outside our control. If you believe you have not received your product, contact contact@eliasmoen.com.

Right of Withdrawl and Refunds

Under Norwegian law (angrerettloven), consumers normally have a 14-day right of withdrawal on purchases made online. However, this right does not apply to digital content that is not supplied on a physical medium, provided that:

(a) you have given your prior, explicit consent for delivery to begin before the 14-day withdrawal period has expired, and (b) you have acknowledged that you thereby lose your right of withdrawal.

By checking the relevant consent box at checkout and completing your purchase, you confirm that you request immediate delivery of the digital Product and expressly waive your right of withdrawal once the download has been made available to you.

As a result, all sales are final once the download link has been delivered. We do not offer refunds, except where required by mandatory consumer protection law (for example, if the Product is materially defective or not as described).

If you experience a genuine technical problem with a Product (e.g. corrupted files), contact contact@eliasmoen.com and we will do our best to resolve it, which may include re-sending files or, at our discretion, a refund.

License to Use Products

When you purchase a Product, you are granted a limited, non-exclusive, non-transferable license to use the Product for your own personal or commercial music/content production purposes (e.g. using a theme while producing and releasing your own music, or using a sample pack in your own tracks).

Unless explicitly stated otherwise on the Product page, you may not:

Resell, redistribute, share, or give away the Product (or any part of it) in its original or a repackaged form, whether for free or for payment;
Claim the Product itself as your own original creation (e.g. reselling a theme file as if you made it);
Upload the Product to third-party marketplaces, file-sharing sites, or "pack" it into a competing product.

Sample packs: unless otherwise stated, audio created using the samples in your own musical compositions may be distributed/sold/streamed as part of your music, but the raw, unprocessed samples themselves may not be redistributed standalone.

We reserve the right to update license terms for future Products; the terms shown at the time of purchase apply to that purchase.

Intellectual Property

All Products, along with the Site's content, design, branding, and the "NXC" and "PhantomLavender" names, remain the intellectual property of Elias Mahle Moen unless otherwise stated. Purchasing a Product grants you a license to use it as described in Section 6 — it does not transfer ownership or copyright to you.

Customer Communications

If you provide your email address (via checkout or elsewhere on the Site), we may use it to send you information related to your purchase, product updates, and — if you opt in — occasional updates about new Products, releases, or offers. See our Privacy Policy for details. You can unsubscribe from marketing emails at any time.

Limitation of Liability

The Products are provided "as is." To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Products or the Site, including but not limited to loss of data, loss of profits, or software compatibility issues.

Nothing in these Terms limits any liability that cannot be excluded under Norwegian or EU consumer protection law.

Changes to These Terms

We may update these Terms from time to time. The version published on the Site at the time of your purchase applies to that purchase. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

Governing Law and Disputes

These Terms are governed by Norwegian law. Any disputes shall be subject to the jurisdiction of Norwegian courts, without prejudice to any mandatory consumer protection rights you may have in your own country of residence under EU/EEA law.
